Terms and Conditions of Participation for Student Organizations

Introduction

Welcome to the NijiPop Culture Festival! This document outlines the Terms and Conditions (T&Cs) for the participation of student organizations (hereafter referred to as "Participants") in the festival. By registering to participate, Participants agree to these T&Cs, which are designed to ensure a positive and respectful environment for all involved.

General Eligibility

• Participation is open to student organizations officially recognized by educational institutions.
• Participants must have an interest or focus in areas relevant to the festival's themes, including but not limited to pop culture, arts, technology, and entertainment.

Booth Operation and Conduct

• Participants may be allocated booth space subject to availability. Booths must be staffed by representatives of the participating organization throughout the festival's operating hours.
• Participants are responsible for the conduct of their representatives. Respectful behavior towards festival attendees, fellow participants, and staff is required at all times.

Promotions

• Participants agree to share all official NijiPop Culture Festival social media posts on their organization's social media pages to enhance the event's visibility and engagement.
• Participants agree to take part in all promotional campaigns of NijiPop Culture Festival.

Compliance and Enforcement

• Adherence to these T&Cs is essential.
• A two-strike rule will apply for non-compliance:
  • First Strike: A written warning will be issued, detailing the non-compliance.
  • Second Strike: Further non-compliance will result in expulsion from the festival without refund or compensation and may impact the participant's eligibility for future festivals.

Intellectual Property and Liability

• Participants are responsible for ensuring that the content displayed or sold at their booth does not infringe on any third-party intellectual property rights.
• Fan-made items are allowed provided, that the fan-made items fall under the label of Fair Use and that creation of fan-made items are not explicitly prohibited by the copyright holders.
• The festival disclaims liability for loss, damage, theft, or injury occurring during the event.

Cancellation Policy

• Cancellation by participants must be communicated in writing at least 30 days prior to the festival.

Breach of Terms Policy

In the event of a breach of these Terms and Conditions by the Participant, including but not limited to failure to comply with the mandatory social media sharing requirement, disruptive behavior, or infringement of intellectual property rights, the Participant agrees to reimburse NijiPop Culture Festival for any and all expenses incurred during the partnership's duration. This includes, but is not limited to:

• The total value of coupons distributed as part of the partnership agreement.
• The cost of discounts provided to the Participant's members.
• The value of supplies for giveaways provided to the Participant.
• The value of any additional perks or benefits extended to the Participant under the partnership agreement.

Reimbursement is expected to be made in full within thirty (30) days of the termination of participation or upon receipt of an invoice from NijiPop, whichever occurs first. Failure to make the required reimbursement may result in further legal action and will impact the Participant's eligibility for future participation in the NijiPop Culture Festival and other associated events.

Amendments to Terms and Conditions

• The festival organizers reserve the right to amend these T&Cs as necessary. Participants will be notified of significant changes.

Governing Law

• These T&Cs shall be governed by the laws of the jurisdiction in which the festival is held.

Acknowledgment and Agreement

By registering for the NijiPop Culture Festival, the participating organization acknowledges that it has read, understood, and agreed to comply with these T&Cs. The participant recognizes the importance of adherence to ensure a successful and enjoyable festival for all involved.
